This agreement governs the relationship between Ame After Dark and the Client(s) engaging their services for custom audio recordings.

General Terms

• Commissions are custom audio recordings based on Client specifications.

• All portrayed characters must be 18+ years old.

• Audio length and content must be agreed upon before payment.

• Ame After Dark reserves the right to:

  • Decline requests that cause discomfort.

  • Cancel commissions due to poor communication, rude/inappropriate behavior, or breach of these terms.

• Ame After Dark may reject projects at any stage, refunding payments minus a $25 consultation fee.

Age and Legality

• Clients must be of legal adult age as per their local laws.

• Ame After Dark is not liable for minors accessing their adult-labeled content.

• By engaging with Ame After Dark, Clients confirm the legality of the content in their jurisdiction and assume all related legal responsibilities.

Payments

• A non-refundable 50% payment is required upfront before work begins.

• The remaining 50% is due upon completion before delivery.

• Prices are as listed in the services section and subject to change without notice.

• Rush orders may incur additional fees.

• Full payment may be required upfront based on the payment method.

Commission Rights and Restrictions

• Clients receive personal use rights for commissioned audio; commercial rights are not granted for personal commissions.

• Purchased commissions do not grant Clients rights to:

  • Claim the work as their own.

  • Repurpose or use the content beyond the agreed purpose.

  • Include unapproved content in the commissioned work.

  • Sell or distribute the work without prior agreement.

• Any unauthorized use may result in legal action.

• Ame After Dark retains the right to use commissions in their portfolio and promotional materials.

AI Usage

• Using Ame After Dark’s voice or content for AI purposes is strictly prohibited.

• Legal action will be taken against any party using Ame After Dark’s content for AI-voiced material.

Credit Requirements

• Clients must provide appropriate credit for Ame After Dark’s work unless otherwise agreed in writing.

• Credits must not imply endorsement by Ame After Dark.

Rewrites, Revisions, and Edits

• One minor revision (e.g., pronunciation corrections, small adjustments) is included, requested within 48 hours of delivery.

• Major revisions or re-recordings are charged as new commissions.

• No rewrites, revisions, or edits are accepted after the invoice is sent or post-delivery window.

• Client errors (e.g., script changes, mispronunciations due to lack of guidance, or new information post-acceptance) may incur additional fees or cancellation.

Deadlines and Delivery

• Standard delivery is 28–54 days for Personal Commissions or 7-14 days for Commercial Commissions from payment confirmation.

• Rush delivery is available for an additional fee.

• Delivery times may extend during high-volume periods.

• Files are delivered via Audiochan as a private link and or direct download through mediafire.

Ownership of Materials

• Clients certify that all materials provided for commissions are:

  • Owned by the Client or their company/group.

  • Publicly available with or without credit.

  • Used with proper permission, with proof if required.

• Ame After Dark will not accept commissions involving copyrighted or stolen material, and Clients bear full responsibility for any violations.

Refunds

• Refunds are provided only if Ame After Dark cannot complete the commission.

• No refunds are issued after audio delivery.

• Cancellations within 24 hours of payment may receive a full refund; partial refunds for later cancellations are at Ame After Dark’s discretion.

Communication

• All communication must use Ame After Dark’s provided contact methods.

• Allow 24–48 hours for responses.

• Updates on commission progress will be provided as needed.

• Clear communication of requirements ensures satisfaction.

Confidentiality

• Both parties agree to protect sensitive information, including legal names, email addresses, payment details, private communications, and project documents.

• Screenshots may be collected for cases of Client neglect (e.g., non-payment, harassment, unprofessional conduct), with personal information redacted except usernames.

Rights to Sell

• A discount is offered for personal commissions if Ame After Dark retains rights to sell the product.

• This applies only to projects using Ame After Dark’s voice or hired voice actors.

• Clients may still receive credit.

• This discount does not apply to commercial commissions intended for public sale by the Client.

Additional Terms

• Ame After Dark may sign NDAs for select projects.

• Ame After Dark reserves the right to list Clients and link released commissions in their portfolio, Patreon, or social media.

• Non-compliance may result in a DMCA claim and content removal.
